Surplus Income in the Bankruptcy Process

Based on income levels set by the Superintendent of Bankruptcy, a potential bankruptcy applicant’s income is evaluated to determine if Surplus Income exists. If it does, the individual can be looking at an extended bankruptcy period (from 9 to 21 months for first time bankrupts) and being required to pay money into their Bankruptcy Estates for disbursement to creditors.
